FMCSA надала Covenant Transport Inc. і Landair Transport Inc., які спільно працюють як Covenant Logistics, дворічне виключення зі строком від 30 липня 2024 року до 30 липня 2026 року. Загальне правило та вузьке виключення
За загальним правилом 49 CFR 383.25(a)(1) CLP holder під час керування CMV має перебувати під наглядом CDL holder із належним class та endorsements, який сидить поруч на передньому сидінні. Виключення Covenant дозволяло відповідному водієві після успішного skills test керувати CMV, коли supervising CDL holder перебував у cab, але не обов’язково на передньому пасажирському сидінні, за умови наявності документа про складений тест та виконання інших умов FMCSA. Воно не поширюється на інших carriers.
Статус запиту на продовження
21 квітня 2026 року FMCSA опублікувала заявку Covenant Logistics на п’ятирічне renewal та приймала comments до 21 травня. У notice прямо зазначено, що публікація заявки не означає, яке рішення ухвалить agency. Станом на ранок 30 липня на офіційній сторінці FMCSA немає опублікованого final disposition щодо цього renewal, а актуальний список CVSA все ще показує дату завершення 30 липня 2026 року. Водіям потрібне письмове підтвердження від safety або compliance department перед рейсом за цією схемою.
Практичні наслідки для українських водіїв
Український CLP holder у Covenant Logistics має перевірити три речі: чи вже видано CDL у state of domicile, чи є чинне письмове підтвердження company authority після 30 липня та де саме повинен перебувати supervising CDL holder. Не починайте рейс лише на підставі старої копії exemption або усної відповіді dispatcher. Це питання не змінює immigration eligibility, ELDT або результати skills test; воно стосується лише законного supervision під час короткого періоду між складеним тестом і видачею CDL document.

What changes after July 30
FMCSA granted Covenant Transport Inc. and Landair Transport Inc., jointly doing business as Covenant Logistics, a two-year exemption effective from July 30, 2024, through July 30, 2026. It applies only to certain CLP holders who have already passed the CDL skills test but have not yet received the physical CDL document. If a renewal does not take effect for the following period, this company-specific exemption will no longer cover those operations beginning July 31.
The general rule and the narrow exemption
Under the general rule in 49 CFR 383.25(a)(1), a CLP holder operating a CMV must be supervised by a properly classed and endorsed CDL holder seated beside the driver in the front seat. The Covenant exemption allowed an eligible driver who had passed the skills test to operate while the supervising CDL holder was in the cab but not necessarily in the front passenger seat, provided the driver carried proof of passing the test and met the other FMCSA conditions. It does not apply to other carriers.
Status of the renewal request
On April 21, 2026, FMCSA published Covenant Logistics’ request for a five-year renewal and accepted comments through May 21. The notice expressly states that publication of the application does not indicate the agency’s ultimate decision. As of the morning of July 30, FMCSA’s official page does not show a published final disposition on the renewal, and CVSA’s current listing still shows an end date of July 30, 2026. Drivers should obtain written confirmation from the company’s safety or compliance department before operating under this arrangement.
Practical implications for Ukrainian drivers
A Ukrainian CLP holder at Covenant Logistics should verify three things: whether the state of domicile has already issued the CDL, whether there is current written confirmation of company authority after July 30, and where the supervising CDL holder must be seated. Do not begin a trip based only on an old exemption copy or a dispatcher’s verbal assurance. This issue does not change immigration eligibility, ELDT completion or skills-test results; it concerns lawful supervision during the short period between passing the test and receiving the CDL document.
