Що FMCSA схвалила 7 жовтня

FMCSA надала limited five-year exemption Aurora Operations та іншим motor carriers, які експлуатують Level 4 automated driving system-equipped CMVs і подадуть required prior notice. На covered vehicle спеціальні flashing amber beacons, встановлені на cab, можуть замінити warning devices, які зазвичай розміщують перед і позаду stopped CMV. Рішення звільняє лише від визначених вимог 49 CFR 392.22(b), 393.25(e) та 393.95(f); exemption effective 7 жовтня 2026 року і expires 7 жовтня 2031 року.

Це не blanket exemption для всіх trucks

Рішення не дозволяє звичайному truck із human driver прибрати reflective triangles із equipment або замінити їх будь-якою flashing light. Воно охоплює лише Level 4 ADS-equipped CMVs, що працюють під exemption. Будь-який carrier, крім Aurora, повинен до початку covered operations письмово повідомити FMCSA, зазначити legal name, USDOT number, principal place of business і contact, підтвердити наявність compliant beacons та certified compliance under penalty of perjury.

Ключові technical та operational conditions

Covered beacons мають бути amber, відповідати SAE J595 Class 1, включати forward-facing light і по одному rearward-facing light з кожного боку cab, бути mounted щонайменше 100 inches над землею та мати redundant power. Вони повинні activate as soon as possible, але не пізніше п’яти хвилин після qualifying stop, і залишатися flashing до відновлення руху або recovery. Звичайні hazard flashers також мають працювати весь час stop.

Де й для яких loads exemption не працює

Operations дозволені лише на roadways у validated Operational Design Domain конкретного ADS vehicle. Exemption не можна використовувати для operations, які за наявності human driver вимагали б H, X, P або S endorsement; воно забороняє covered passenger-carrier operations і transportation hazardous materials. LCV operations обмежені doubles із двома 28-foot trailers, без triples. Усі інші applicable Federal Motor Carrier Safety Regulations залишаються чинними.

Reporting і можливе revocation

Carrier має повідомити FMCSA не пізніше п’яти calendar days про crash, коли beacons були або мали бути activated. Annual report до 1 листопада повинен охоплювати fleet count, miles, malfunctions, power issues, mounting locations та equipment variations. FMCSA може revoke exemption для окремого carrier або всіх covered carriers за noncompliance, lower level of safety або несумісність із federal safety goals.

Що це означає для українських CDL drivers

Для українського company driver або owner-operator із conventional truck нічого в roadside triangle procedure не змінилося: carrier повинен мати required warning devices, а driver має виконувати 49 CFR 392.22, якщо інше specific exemption не застосовується. Побачивши stopped autonomous truck із high-mounted amber beacons, завчасно зменшуйте speed, збільшуйте following distance та будьте готові змінити lane безпечним способом. Не припускайте, що на pavement обов’язково будуть triangles.

CDL та immigration status не змінюються

Exemption стосується warning equipment на limited class autonomous CMVs. Воно не змінює eligibility для CDL або non-domiciled CDL, ELDT, English-language proficiency, medical certification, work authorization, visa, U4U parole, TPS чи EAD. Human drivers повинні й надалі виконувати всі вимоги до своїх credentials та роботи; carrier не може посилатися на це рішення як на immigration або licensing relief.

What FMCSA approved on October 7

FMCSA granted a limited five-year exemption to Aurora Operations and other motor carriers operating Level 4 automated-driving-system-equipped CMVs that provide the required advance notice. On a covered vehicle, specified flashing amber beacons mounted on the cab may replace the warning devices normally placed in front of and behind a stopped CMV. The decision provides relief only from specified requirements in 49 CFR 392.22(b), 393.25(e) and 393.95(f); the exemption is effective October 7, 2026, and expires October 7, 2031.

This is not a blanket exemption for every truck

The decision does not allow an ordinary truck with a human driver to remove reflective triangles from its equipment or replace them with any flashing light. It covers only Level 4 ADS-equipped CMVs operating under the exemption. Before beginning covered operations, every carrier other than Aurora must notify FMCSA in writing, identify its legal name, USDOT number, principal place of business and contact, demonstrate that it has compliant beacons, and certify compliance under penalty of perjury.

Key technical and operating conditions

Covered beacons must be amber, meet SAE J595 Class 1, include a forward-facing light and a rearward-facing light on each side of the cab, be mounted at least 100 inches above the ground, and use redundant power. They must activate as soon as possible, but no later than five minutes after a qualifying stop, and keep flashing until the vehicle resumes movement or is recovered. The vehicle’s ordinary hazard flashers also must remain active throughout the stop.

Where and for which loads the exemption does not apply

Operations are allowed only on roadways within the validated Operational Design Domain of the specific ADS vehicle. The exemption cannot be used for operations that would require an H, X, P or S endorsement if a human driver were present; covered passenger-carrier operations and transportation of hazardous materials are prohibited. Longer-combination-vehicle operations are limited to doubles with two 28-foot trailers, with no triples. All other applicable Federal Motor Carrier Safety Regulations remain in effect.

Reporting and possible revocation

A carrier must notify FMCSA within five calendar days of a crash when the beacons were activated or should have been activated. An annual report due by November 1 must cover fleet count, mileage, malfunctions, power issues, mounting locations and equipment variations. FMCSA may revoke the exemption for one carrier or all covered carriers for noncompliance, a lower level of safety or inconsistency with federal safety goals.

What this means for Ukrainian CDL drivers

For a Ukrainian company driver or owner-operator in a conventional truck, nothing has changed in the roadside-triangle procedure: the carrier must carry the required warning devices, and the driver must follow 49 CFR 392.22 unless another specific exemption applies. When approaching a stopped autonomous truck displaying high-mounted amber beacons, reduce speed early, increase following distance and prepare for a safe lane change. Do not assume that triangles will necessarily be placed on the pavement.

CDL and immigration status do not change

The exemption concerns warning equipment on a limited class of autonomous CMVs. It does not change eligibility for a CDL or non-domiciled CDL, ELDT, English-language proficiency, medical certification, work authorization, a visa, Uniting for Ukraine parole, TPS or an EAD. Human drivers must continue to meet every credential and employment requirement; a carrier cannot treat this decision as immigration or licensing relief.
