Nationwide audit third-party skills testers

DHS описав ongoing investigations into unauthorized employment, identity-document fraud, CDL medical-certification fraud, labor exploitation та other suspected crimes. DOJ створив Joint Task Force Crossroads of America, який об’єднує federal prosecutors і agencies в Illinois, Indiana, Michigan та Ohio. Оголошення про investigation не доводить wrongdoing конкретного driver, carrier, school або medical examiner. Ukrainian nationality, Uniting for Ukraine parole, TPS або EAD не роблять школу compliant і не роблять водія порушником. Окремо перевіряйте current work authorization, CDL або CLP status, medical certification, ELDT record і eligibility under applicable domiciled чи non-domiciled rules. Не передавайте original immigration documents school recruiter або unverified agent, не погоджуйтеся на false attendance, test result чи medical record і зберігайте письмові докази legitimate training. Якщо agency надсилає notice, перевірте sender через official website та зверніться до qualified attorney за індивідуальною порадою.

What FMCSA announced on August 31
On August 31, 2026, FMCSA announced three distinct enforcement actions: emergency removal of more than 110 Entry-Level Driver Training providers from the Training Provider Registry, notices of proposed removal for more than 160 additional providers following investigations in 40 states, and a nationwide audit of third-party CDL skills testers and state oversight. The agency linked the emergency removals to more than 5,000 drivers who later received roadside English Language Proficiency violations. These are FMCSA statements and administrative actions, not an individualized court finding about every student.
Emergency removal and proposed removal are different
The more than 110 providers identified for emergency removal must immediately cease ELDT operations. More than 160 others received notices of proposed removal over alleged deficiencies such as inadequate range space, unlicensed instructors, missing assessment records and questionable classroom facilities. Proposed removal is an administrative process, not a confirmed final removal. DHS also reported serving inspection notices at more than 200 schools in 23 states; an inspection notice by itself is not a closure, criminal charge or proof of fraud.
What this means for current students
Before the next class, payment or skills-test appointment, locate the school’s exact legal name and location in the current FMCSA Training Provider Registry. FMCSA guidance states that training conducted after the removal date is invalid. The announcement does not say that every ELDT completion submitted before removal is automatically canceled. If a provider disappears from the TPR, suspends training or cannot confirm submission, retain the contract, receipts, attendance and completion records and obtain written instructions from FMCSA and the state DMV before paying for training again.
Nationwide audit of third-party skills testers
FMCSA is also beginning a nationwide audit of people and organizations authorized by states to administer CDL skills tests and will examine the adequacy of state oversight. The federal announcement does not halt every third-party test or automatically decertify any state CDL program. A driver should use only a tester currently recognized by the licensing state, personally complete the test in English and never pay intermediaries for a guaranteed pass, interpreter or altered result.
Coordinated DHS and DOJ actions
DHS described ongoing investigations involving unauthorized employment, identity-document fraud, CDL medical-certification fraud, labor exploitation and other suspected crimes. DOJ formed the Joint Task Force Crossroads of America, bringing together federal prosecutors and agencies in Illinois, Indiana, Michigan and Ohio. An investigation does not prove wrongdoing by a particular driver, carrier, school or medical examiner. Drivers and employers should nevertheless expect closer review of Form I-9 compliance, work authorization, CDL records, medical certification and English communication during inspections.
Practical implications for Ukrainians
Ukrainian nationality, Uniting for Ukraine parole, Temporary Protected Status or an Employment Authorization Document does not make a school compliant or make a driver a violator. Separately verify current work authorization, CDL or CLP status, medical certification, ELDT record and eligibility under the applicable domiciled or non-domiciled rules. Do not give original immigration documents to a school recruiter or unverified agent, agree to false attendance, test results or medical records, and retain written evidence of legitimate training. If an agency sends a notice, verify the sender through an official website and consult a qualified attorney for individualized advice.
