On September 24, FreightWaves reported that attorneys now represent at least 45 Mexican commercial drivers describing substantially similar recruitment experiences. The pending federal case has 29 anonymous plaintiffs; the remaining drivers have not necessarily been added to the complaint. This is an increase in the number represented, not a new court finding or government enforcement action.

What the plaintiffs allege

The First Amended Complaint alleges that recruiters promised lawful work authorization, employment-based visas or permanent residence, charged activation or visa-processing fees, and that some drivers later faced deductions, retention of passports or I-94 records, threats of deportation, penalties or blacklisting, and unpaid work. The plaintiffs assert claims under the federal Trafficking Victims Protection Reauthorization Act, RICO, the Fair Labor Standards Act and California law. Keep control of passports, I-94 records, EADs, pay statements, settlement sheets, ELD and dispatch records, messages and receipts; do not surrender originals without a lawful need and a receipt. If documents are withheld, immigration consequences are threatened or debt is used to compel work, contact qualified counsel and DOL or DOJ resources.
