Barron’s Law Introduced in the House: What H.R. 10620 Proposes for CDLs and Immigrant Drivers
H.R. 10620 пропонує пов’язати CDL issuance і renewal з work authorization для керування CMV, запровадити стандартизований English test, посилити penalties для carriers і cabotage enforcement.
House Committee on Transportation and Infrastructure.
Office of Rep.
CDL issuance, renewal і work authorization
За legislative descriptions, applicants мали б бути U.S. citizens, lawful permanent residents або otherwise federally authorized to work in employment that includes operating a commercial motor vehicle. Чинна eligibility визначається current federal rule, state procedures та individual documents.
English test
Reporting on the bill says CDL applicants and renewing drivers would take a standardized FMCSA-approved English-language proficiency assessment covering signs, safety instructions, spoken and emergency communication, logs and reports. Current 49 CFR 391.11(b)(2) already requires sufficient English for defined CMV tasks, and FMCSA already has a roadside assessment policy. H.R. 10620 would add a licensing-stage test if enacted; it does not replace or postpone current roadside enforcement while pending.
Carrier penalties, chameleon carriers і cabotage
Proposal також спрямоване на chameleon carriers та передбачає до $100,000 per vehicle per day за knowing unlawful cabotage, тобто unauthorized domestic point-to-point hauling by a foreign carrier.
GPS та ELD pilot у ports of entry
Proposal також описує pilot program із GPS, ELD data та geofencing у high-volume land ports of entry для виявлення можливого unlawful domestic freight movement by foreign-domiciled carriers.
До enactment практичні obligations залишаються тими, що встановлені чинними statutes, FMCSA regulations, enforcement policies і state DMV procedures.
Status: a proposal, not a new rule
The congressional record and official announcement show that Representative Brandon Gill introduced H.R. 10620 on September 28, 2026, and that it was referred to the House Committee on Transportation and Infrastructure. As of October 2, it has not passed the House or Senate and has not been signed by the President. Barron’s Law therefore creates no new CDL test, revocation deadline, roadside document or carrier penalty today.
What the sponsor officially confirms
Rep. Gill’s office identifies four principal areas: lawful status or proper employment authorization for trucking licenses, English-language proficiency testing, anti-fraud measures and increased penalties for motor carriers that knowingly use ineligible drivers. The announcement also identifies three cosponsors. This is the sponsor’s description of the bill, not an agency or court finding about any individual driver.
CDL issuance, renewal and work authorization
Legislative descriptions say applicants would have to be U.S. citizens, lawful permanent residents or otherwise federally authorized to work in employment that includes operating a commercial motor vehicle. States could issue a CDL or CLP only to eligible applicants, and federal CDL records would carry an eligibility indicator without storing the underlying immigration documents. The key word is “would”: these provisions are not in effect. Current eligibility is governed by the existing federal rule, state procedures and individual documents.
The proposed English test
Reporting on the bill says CDL applicants and renewing drivers would take a standardized FMCSA-approved English-language proficiency assessment covering signs, safety instructions, spoken and emergency communication, logs and reports. Current 49 CFR 391.11(b)(2) already requires sufficient English for defined CMV tasks, and FMCSA already has a roadside assessment policy. H.R. 10620 would add a licensing-stage test if enacted; it does not replace or postpone current roadside enforcement while pending.
Carrier penalties, chameleon carriers and cabotage
FreightWaves and detailed legislative reporting describe proposed civil penalties of at least $25,000 for carriers that knowingly use ineligible operators, with higher penalties in serious-injury or fatal cases. The proposal also targets chameleon carriers and would allow penalties up to $100,000 per vehicle per day for knowing unlawful cabotage—unauthorized domestic point-to-point hauling by a foreign carrier. These dollar amounts are proposed provisions, not currently enforceable H.R. 10620 penalties.
GPS and ELD pilot at ports of entry
The proposal also describes a pilot program using GPS, ELD data and geofencing at high-volume land ports of entry to identify possible unlawful domestic freight movements by foreign-domiciled carriers. Public descriptions do not define every operational detail, privacy safeguard, participating port or data-retention term. Even if Congress enacts the bill, implementation would depend on the final text, agency rules, appropriations and program design.
Practical implications for Ukrainian and immigrant drivers
Do not surrender, downgrade or transfer a CDL merely because of a headline about H.R. 10620. Verify the current license status with the issuing DMV and follow existing FMCSA rules. Ukrainians with Uniting for Ukraine parole, TPS, an EAD, a visa or a non-domiciled CDL should separately determine whether their documents authorize the specific CMV employment and CDL transaction under current law; a general EAD should not automatically be treated as the answer for every CDL category. Prepare for the current roadside ELP standard, retain DMV notices and do not rely on social-media claims that the bill already “banned” or “canceled” a license.
What to monitor next
Check Congress.gov for committee action, amendments, hearings, votes and new versions of the text. The bill may change, be incorporated into another package, receive no vote or never become law. Until enactment, practical obligations remain those established by existing statutes, FMCSA regulations, enforcement policies and state DMV procedures.
