What happened on September 11

A three-judge panel of the U.S. Court of Appeals for the D.C. Circuit heard oral argument in California Department of Motor Vehicles v. U.S. Department of Transportation, No. 26-1027. The parties dispute the legality of the federal directive that led California to stop issuing and renewing non-domiciled CLPs and CDLs and DOT to withhold approximately $160 million in highway funding. The published hearing recording confirms that argument occurred; the court has not announced a decision.

What the court is reviewing

The central dispute is whether California cooperated adequately with the FMCSA audit and whether the agency had lawful grounds to require the pause. A separate technical issue is whether some CDL expiration dates could extend beyond the date shown on documents establishing lawful presence or work authorization. The hearing was not an individual review of every driver’s immigration status and does not, by itself, renew, cancel or modify a particular credential.

California’s position

California argued that the federal rules in effect when the disputed credentials were issued did not require every CDL expiration date to match the end date on a lawful-presence document. The state also disputes that its audit response justified a complete halt to new issuances and renewals. These are a party’s arguments in pending litigation, not findings by the court.

DOT and FMCSA’s position

The federal government argued that California improperly issued approximately 20,000 of about 65,000 reviewed credentials, including licenses whose expiration extended beyond the documented period of lawful presence. FMCSA previously said more than 17,000 licenses had to be canceled and connected that issue to the withholding of funding. These claims likewise remain the agency’s position in the dispute; the court has not ruled.

What remains in effect in California

California DMV says it has not issued or renewed non-domiciled CLPs or CDLs since September 29, 2025. An affected applicant may submit a new application, but DMV will hold it until the agency is permitted to act. Under a separate official notice, credentials not covered by the cancellation action remain valid until their current expiration, but cannot be renewed, replaced or changed during the pause. Rely on the individual DMV record and written notices, not merely headlines about the hearing.

This is separate from the nationwide rule challenge

California DMV v. DOT concerns federal action directed at California, the audit and funding. A separate case, Rivera Lujan v. FMCSA, challenges the nationwide 2026 final rule governing eligibility for non-domiciled CDLs; oral argument in that case is scheduled for September 15. A hearing or ruling in one case should not automatically be treated as controlling the other.

Practical implications for Ukrainian drivers

The hearing does not restore eligibility or extend a CDL for holders of Uniting for Ukraine parole, TPS, asylum-related documents or an EAD. Check status and expiration with California DMV; retain cancellation or application notices, lawful-presence documents, the EAD and receipts; and have the employer separately verify work authorization and driving privileges. Do not operate a CMV after an actual cancellation, downgrade or expiration. If a notice conflicts with the record or documents, consult a qualified licensing or immigration attorney.
