What will happen on September 15
The U.S. Court of Appeals for the D.C. Circuit has scheduled oral argument in Rivera Lujan v. FMCSA, No. 26-1032, consolidated with No. 26-1046, for September 15, 2026. The parties will present their positions on the legality of the February 2026 final rule, after which the three-judge panel will consider the merits. This is an important next stage of the litigation, but it is not an automatic cancellation or change date for the rule.
The rule being challenged
The FMCSA final rule, published at 91 FR 7044 and effective March 16, 2026, generally limits federal eligibility for a non-domiciled CLP or CDL to applicants in H-2A, H-2B or E-2 status documented by an unexpired foreign passport and Form I-94. It also establishes in-person procedures, verification duties and a shorter license term. The petitioners challenge the agency’s legal authority and reasoning; FMCSA defends the rule as a uniform licensing and safety measure.
The current rule has not been paused
On May 5, the D.C. Circuit denied motions to stay the final rule pending review while granting expedited consideration. The September hearing therefore does not by itself restore eligibility, extend a CDL expiration date or cancel a DMV notice. Unless the court enters a new order or judgment, drivers and state licensing agencies must follow the current regulation, FMCSA FAQs and state-specific procedures.
Why this especially matters to Ukrainian drivers
Many Ukrainians in the United States hold Uniting for Ukraine parole, Temporary Protected Status, an asylum-related status or an Employment Authorization Document. Those documents may establish lawful presence or work authorization for other purposes, but they should not automatically be treated as H-2A, H-2B or E-2 eligibility under the non-domiciled CDL rule. The litigation’s outcome could materially affect future issuance, renewal, transfer, upgrade or reinstatement, but today each driver must verify the individual Form I-94 class, CDL record and written requirements of the licensing state.
What may happen after oral argument
The court could uphold the rule, vacate all or part of it, remand an issue to FMCSA, or enter another procedural order. A decision need not be issued on the hearing date, and further motions or review may follow. Do not rely on social-media summaries: a legal change for a driver begins only with an actual court order, updated federal guidance or an official DMV instruction applicable to the specific transaction.
Practical steps before September 15
Check the expiration dates on the CDL, Form I-94, passport, visa and EAD; obtain a current motor vehicle record; retain every DMV notice; and do not wait until the last day for renewal or medical reinstatement. If a license or job depends on non-domiciled eligibility, request a written answer from the DMV and consult a qualified immigration or administrative-law attorney. An employer or dispatcher cannot change federal licensing eligibility.
