Що змінилося 18 вересня
FMCSA запровадила enhanced requirements для State data reviews у DataQs. Online system дозволяє commercial drivers, carriers та іншим parties просити перевірити federal або state crash, inspection і violation data, які вони вважають incomplete чи incorrect. Нові вимоги не є retroactive: вони застосовуються до Requests for Data Review, поданих 18 вересня 2026 року або пізніше. Раніше подані requests продовжують розглядатися за попереднім process.
Три незалежні рівні review
State RDR process тепер має Initial Review, Reconsideration і Final Review. Issuing officer або inspector не може бути єдиним decision-maker, якщо Initial Review завершується без correction. Reconsideration має розглядати інша особа або panel із відповідною subject-matter expertise; issuing officer, inspector та їхній immediate supervisor виключені. Final Review переходить до окремого responsible decision-maker, panel або іншого unbiased process, який не брав участі у двох попередніх рішеннях.
Строки для state RDR
State має відкрити Initial Review протягом 7 calendar days і повідомити рішення протягом 21 дня від submission. Reconsideration decision також має надійти протягом 21 дня, а Final Review — протягом 45 днів. Requestor має 30 днів після попереднього decision, щоб подати Reconsideration або Final Review. Якщо State просить relevant additional information, у requestor є 14 днів на відповідь; цей період не зараховується до 21- або 45-day state deadline. Ці строки стосуються State reviews за новими MCSAP requirements; FMCSA окремо зазначала, що оцінює подібні standards для federal inspection-related RDRs.
Evidence і burden of proof
Burden of proof залишається на requestor. Initial request має пояснити factual або legal reason, чому record є incorrect чи incomplete, і додати supporting documents. Для appeal недостатньо просто написати, що ви не згодні: потрібно відповісти на factual або legal basis попереднього decision. New, unrequested evidence на appeal stage може повернути RDR до Initial Review, щоб State оцінив повний record. Decision без correction має назвати evidence reviewed, decision-maker, конкретні reasons і next steps.
Що DataQs може — і чого не може
DataQs може виправити incomplete або incorrect data, submitted to and stored by FMCSA, якщо evidence supports correction. Це може бути важливо для driver або carrier safety records, але submission не гарантує зміни й не зупиняє enforcement автоматично. DataQs не є court appeal для traffic citation, не скасовує conviction, не reinstates CDL, не виправляє immigration status і не замінює state DMV hearing. Якщо citation оскаржується в court, дотримуйтеся окремого court deadline; court disposition може стати важливим supporting document для DataQs.
Практичні кроки для українських водіїв
Ukrainian citizenship, U4U parole, TPS, asylum-related status, visa або EAD не змінюють DataQs evidence rules. Спочатку завантажте inspection або crash record і точно визначте disputed field. Додайте legible inspection report, citation і court disposition, photos, repair records, ELD logs, bills of lading або інший directly relevant evidence; для українських документів додайте зрозумілий English translation. Збережіть confirmation, перевіряйте messages у DataQs, відповідайте на State request у 14-day window і подавайте appeal не пізніше 30 днів після decision.

What changed on September 18
FMCSA implemented enhanced requirements for state data reviews in DataQs. The online system allows commercial drivers, carriers and other parties to request review of federal or state crash, inspection and violation data they believe is incomplete or incorrect. The new requirements are not retroactive: they apply to Requests for Data Review submitted on or after September 18, 2026. Earlier requests continue under the prior process.
Three independent review levels
The state RDR process now has Initial Review, Reconsideration and Final Review stages. The issuing officer or inspector may not be the sole decision-maker when an Initial Review closes without a correction. Reconsideration must be handled by a different person or panel with appropriate subject-matter expertise; the issuing officer, inspector and their immediate supervisor are excluded. Final Review moves to a separate responsible decision-maker, panel or other unbiased process that was not involved in either earlier decision.
Timelines for a state RDR
A state must open the Initial Review within seven calendar days and communicate a decision within 21 days of submission. A Reconsideration decision also is due within 21 days, while Final Review is due within 45 days. The requestor has 30 days after the prior decision to seek Reconsideration or Final Review. If the state requests relevant additional information, the requestor has 14 days to respond; that period does not count against the state’s 21- or 45-day deadline. These timelines govern state reviews under the revised MCSAP requirements; FMCSA separately said it was evaluating similar standards for federal inspection-related RDRs.
Evidence and burden of proof
The burden of proof remains with the requestor. An initial request must explain the factual or legal reason the record is incorrect or incomplete and include supporting documents. Merely stating disagreement is not enough on appeal; the filing must address the factual or legal basis of the prior decision. New, unrequested evidence introduced during an appeal may return the RDR to Initial Review so the state can evaluate the full record. A decision making no correction must identify the evidence reviewed, the decision-maker, specific reasons and next steps.
What DataQs can—and cannot—do
DataQs can correct incomplete or incorrect data submitted to and stored by FMCSA when the evidence supports a correction. That may matter to driver or carrier safety records, but a submission does not guarantee a change or automatically pause enforcement. DataQs is not a court appeal for a traffic citation, does not vacate a conviction, reinstate a CDL, correct immigration status or replace a state DMV hearing. If a citation is being challenged in court, meet the separate court deadline; the court disposition may become important supporting documentation for DataQs.
Practical steps for Ukrainian drivers
Ukrainian citizenship, Uniting for Ukraine parole, TPS, asylum-related status, a visa or an EAD does not change the DataQs evidence rules. First, download the inspection or crash record and identify the exact field in dispute. Include a legible inspection report, citation and court disposition, photographs, repair records, ELD logs, bills of lading or other directly relevant evidence; provide a clear English translation for Ukrainian documents. Save the confirmation, monitor DataQs messages, answer a state information request within the 14-day window and file any appeal no later than 30 days after the decision.
