What FMCSA decided

In a final disposition published September 30, FMCSA denied the Federation of Professional Truckers (FOPT) application. The organization sought to let professional drivers choose manual records of duty status instead of an ELD. The agency concluded that the proposed exemption would not achieve a level of safety equivalent to or greater than the existing requirement. No new nationwide right to switch to paper logs by preference was created.

Why the application was denied

FMCSA explained that Congress, through MAP-21, mandated ELDs for interstate CMVs operated by drivers who must keep RODS, so the agency cannot grant a blanket exemption to any driver or carrier that simply prefers not to use an ELD. FOPT proposed education, random internal audits and exclusion of violators, but sought relief beyond its own members. In FMCSA's view, the application did not explain how those safeguards would work for an undefined driver population.

Separate rules also govern ELD malfunctions and transition periods after a specific device is revoked. Those situations are not the same as permanently choosing paper logs instead of a compliant ELD.

Practical implications for Ukrainian drivers

Citizenship, parole, TPS, visa category, an EAD or a non-domiciled CDL does not by itself create an ELD exemption. If your trip and operation are subject to the ELD rule, continue using a registered compliant device and verify the carrier policy and current FMCSA status. Keep malfunction instructions, blank paper logs and required supporting records. If a dispatcher suggests switching to paper logs merely because the ELD is inconvenient, ask for the specific regulatory basis and written compliance instructions.

Confirm that the ELD appears on the current registered list rather than merely being installed in the truck; match the identifier, model and provider. For a malfunction, follow the applicable 49 CFR procedure and the carrier escalation process, documenting the time and notice.
