Під час keynote на Women In Trucking Accelerate! Він не назвав proposed number of hours, publication date або effective date.

ELD provider oversight

Barrs також повідомив про work on rulemaking для stronger oversight ELD providers і назвав third-party testing або testing laboratory можливими елементами більш суворого process.

Для Class A і Class B BTW instruction provider має оцінити proficiency на range та public road; federal rule зараз не встановлює єдину minimum кількість training hours.

FMCSA currently relies on provider self-certification and registration, а devices мають відповідати technical specifications in Appendix A to 49 CFR Part 395 Subpart B. Carriers і drivers повинні використовувати registered device, перевіряти live Registered та Revoked lists, зберігати required records і вміти display або transfer RODS під час inspection.

School або recruiter не повинен рекламувати “new federal minimum hours” до publication official proposal або final rule. Перед оплатою перевірте exact provider name і location у TPR, curriculum, BTW vehicle time, instructor qualifications, refund terms і хто submit completion record. Зберігайте contract, receipts, attendance, skill assessments і screenshot TPR record.

Продовжуйте виконувати current training, state testing, medical, English-proficiency та licensing requirements. U4U parole, TPS, visa, EAD, work authorization

IN ENGLISH

What Administrator Barrs said on October 27

During a keynote at the Women In Trucking Accelerate! Conference in Dallas, FMCSA Administrator Derek Barrs said the agency is working on rulemaking for entry-level driver training. He described a future approach that would consider both training hours and demonstrated proficiency. He did not announce a proposed number of hours, a publication date or an effective date. A separate CVTA recap confirms that the keynote addressed driver qualifications, enforcement, carrier accountability and review of existing regulations.

ELD-provider oversight may also change

Barrs also described work on rulemaking for stronger oversight of ELD providers and identified third-party testing or a testing laboratory as possible elements of a more rigorous process. According to the reporting, FMCSA is investigating allegations involving manipulation of electronic logs with federal partners. The agency has not published a formal proposal, laboratory standard, compliance deadline or list of devices that could be affected. This is an announced policy direction, not a new binding requirement.

Which ELDT requirements apply now

Current 49 CFR Part 380 Subpart F establishes minimum curriculum content for theory and behind-the-wheel training. For Class A and Class B behind-the-wheel instruction, the provider must assess proficiency on the range and public road; the federal rule currently does not establish one minimum number of training hours. An applicant subject to ELDT must complete the required training with a provider registered in FMCSA’s Training Provider Registry, and the provider submits certification to the TPR. An oral statement about future rulemaking does not change those requirements.

Which ELD requirements apply now

FMCSA currently relies on provider self-certification and registration, and devices must satisfy the technical specifications in Appendix A to 49 CFR Part 395 Subpart B. Carriers and drivers must use a registered device, check the live Registered and Revoked lists, preserve required records, and be able to display or transfer records of duty status during an inspection. Discussion of possible third-party testing does not restore a revoked device, change an existing replacement deadline or permit editing or falsification of logs.

What this means for CDL schools and applicants

A school or recruiter should not advertise a “new federal minimum number of hours” before an official proposal or final rule is published. Before paying, verify the exact provider name and location in the TPR, the curriculum, behind-the-wheel vehicle time, instructor qualifications, refund terms and who will submit the completion record. Keep the contract, receipts, attendance records, skill assessments and a screenshot of the TPR record. If a future NPRM is published, the Federal Register will provide the comment and compliance dates; conference remarks do not create a deadline.

Practical implications for Ukrainian drivers

A Ukrainian applicant does not need to purchase additional ELDT hours merely because of this statement and should not pay an intermediary for “early compliance.” Continue following current training, state testing, medical, English-proficiency and licensing requirements. Uniting for Ukraine parole, Temporary Protected Status, a visa, an Employment Authorization Document, work authorization and eligibility for a domiciled or non-domiciled CDL remain separate questions. For a working driver, the practical step now is to verify the exact ELD model and identifier on FMCSA’s live lists and report a mismatch, malfunction or suspicious log edit to the carrier’s safety team in writing.
