TPR listing
FMCSA Seeks Emergency Approval to Vet New CDL Schools Before TPR Listing
FMCSA подала до OMB emergency information-collection request, який дозволив би перевіряти curriculum, vehicles, instructors, state authorization і facilities нових ELDT providers та кожної нової location до появи в Training Provider Registry.

Office of Information and Regulatory Affairs при OMB emergency Information Collection Request під назвою “Strengthening the Standards for Initial Listing on the Training Provider Registry (TPR).”
FMCSA перелічує п’ять груп: lesson plans для theory та behind-the-wheel training на range і public road; proof of compliant training vehicles; qualifications instructors і copies їхніх CDL та endorsements, коли це застосовно; proof of state authorization або licensure; і documentation training facility для in-person instruction.
Наразі 49 CFR 380.703 уже вимагає compliant curricula, facilities, vehicles, instructors, state authorization і electronic registration для кожної location, але використовує certification provider.
Перед deposit або tuition знайдіть exact legal name і exact training location у official TPR; окремо перевірте state school license або authorization.
Новим schools і providers, які додають location, варто привести в порядок curriculum, vehicle records, instructor qualifications, state approvals і facility documents, але не надсилати sensitive materials неофіційному intermediary. Дочекайтеся official OMB/FMCSA instructions, approved form і secure submission channel.
U4U parole, TPS, visa, EAD, state residency, CLP
Це не legal, immigration або individualized licensing advice; перевіряйте current TPR, FMCSA, OMB і licensing-state requirements перед оплатою або поданням документів.
What FMCSA submitted
On September 21, 2026, FMCSA submitted an emergency Information Collection Request to the Office of Information and Regulatory Affairs at OMB titled “Strengthening the Standards for Initial Listing on the Training Provider Registry (TPR).” The agency requested approval by September 25 and a six-month approval period. As of October 15, the official Reginfo record still shows “Received in OIRA” and no OMB Control Number. This is a request for approval, not an approved requirement.
Five document groups before listing
If OMB approves the request as proposed, each new provider and each new training location would submit documents before appearing in the TPR. FMCSA identifies five groups: lesson plans for theory and behind-the-wheel training on a range and public road; proof of compliant training vehicles; instructor qualifications and copies of their CDLs and endorsements when applicable; proof of state authorization or licensure; and training-facility documentation for in-person instruction. The agency would review those materials before listing.
Why the agency seeks emergency review
FMCSA explains that current registration relies substantially on provider attestation. According to the agency, a provider emergency-removed from the TPR may try to return with a different name, email address or physical address—a so-called “chameleon” provider. Pre-listing review is intended to make that reentry harder and identify missing vehicles, instructors, curriculum, authorization or facilities earlier. This is FMCSA’s rationale; submitting the ICR does not itself prove fraud by any particular school.
What has not changed
The request is not a final rule, does not create a new student filing requirement and does not cancel current listings. Existing 49 CFR 380.703 already requires compliant curricula, facilities, vehicles, instructors, state authorization and electronic registration for each location, but uses provider certification. Separately, 49 CFR 380.723 allows FMCSA emergency removal in specified circumstances and provides administrative-review and reinstatement processes. The Reginfo record mentions planned rulemaking under RIN 2126-AD00, but this ICR is not that proposed rule.
Practical steps for students
Before paying a deposit or tuition, find the exact legal name and exact training location in the official TPR; separately verify the state school license or authorization. Request a written enrollment agreement, refund policy, schedule and confirmation of who will submit completion. Keep receipts, attendance records, assessments and proof of TPR submission. Do not pay for a “guaranteed pass,” instant certificate or a record of training that did not occur. Check the provider again before the skills test, especially if the school changed its name, address or ownership.
What training providers should prepare
New schools and providers adding a location should organize curriculum, vehicle records, instructor qualifications, state approvals and facility documents, but should not send sensitive materials to an unofficial intermediary. Wait for official OMB/FMCSA instructions, an approved form and a secure submission channel. The Reginfo burden estimate—2,000 responses and 1,000 total hours—is a paperwork planning estimate, not a count of schools found to have violated the rules.
What this means for Ukrainian and immigrant drivers
The proposal concerns oversight of ELDT providers, not student nationality. Uniting for Ukraine parole, TPS, visas, EADs, state residency, CLP and CDL eligibility remain separate issues. The new ICR does not require a student to send a passport, I-94, EAD or Social Security number to a school or third-party “FMCSA agent.” Share sensitive records only through a verified official channel when lawfully required by a DMV, employer or other authorized entity.
