Waiver завершується 26 серпня
FMCSA надала тимчасове waiver через fertilizer supply shortfall на період від 12:00 a.m. 26 травня до 11:59 p.m. 26 серпня 2026 року. Які перевезення та штати були охоплені
Relief стосується straight або blended fertilizer products, які перевозять для commercial farming або agricultural purposes, включно з ranching. Перехід із waiver operations до звичайного рейсу
FMCSA прямо вимагає 10 consecutive hours off duty перед normal operations, якщо загальний час роботи під waiver або поєднання waiver та normal operations дорівнює чи перевищує 14 годин. Водії, які працювали без ELD за waiver, мали вести paper RODS і supporting documents та зберігати їх шість місяців. Expiration не скасовує ці retention duties. Carrier має перевірити available hours, належно закрити paper log і відновити ELD use до наступної операції, для якої ELD є обов’язковим.
Які вимоги waiver ніколи не скасовувало
Waiver не звільняло від CDL requirements, medical qualification, drug and alcohol testing, insurance, vehicle condition, size and weight limits, registration, taxes або інших FMCSRs. Driver з out-of-service order не міг використовувати relief, доки order письмово не rescinded. Чинні license, medical status, proper class та endorsements залишалися обов’язковими протягом усього періоду waiver і залишаються такими після його завершення.
Практичні наслідки для українських водіїв
Citizenship, TPS, U4U parole, visa або EAD не визначають право на fertilizer waiver; вирішальними були cargo, route, state та compliance з його умовами. Українським drivers, які перевозять fertilizer 26–27 серпня, варто отримати письмову dispatch instruction, уточнити час завершення qualifying segment, перевірити available HOS у carrier або ELD system і не вважати стару копію waiver чинною після deadline. Immigration documents і non-domiciled CDL validity потрібно контролювати окремо: це waiver їх не продовжує.

The waiver ends August 26
FMCSA granted the temporary waiver in response to a fertilizer supply shortfall for the period from 12:00 a.m. on May 26 through 11:59 p.m. on August 26, 2026. It relieves qualifying interstate motor carriers and drivers only from the maximum driving-time limits in 49 CFR 395.3 and the ELD requirement for recording duty status in 49 CFR 395.8(a)(1)(i). As of August 26, FMCSA’s official page does not show an extension of this waiver.
Covered transportation and states
The relief applies to straight or blended fertilizer products transported for commercial farming or agricultural purposes, including ranching. It covered Alabama, Arkansas, California, Delaware, Florida, Georgia, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maryland, Michigan, Minnesota, Mississippi, Missouri, Montana, Nebraska, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, South Carolina, South Dakota, Tennessee, Texas, Virginia, Washington, West Virginia, Wisconsin and Wyoming. Hazardous material requiring placards or otherwise meeting the waiver’s federal definition was not covered.
What changes after 11:59 p.m.
After expiration, this document no longer provides authority to exceed the ordinary limits in 49 CFR 395.3 or use paper records of duty status instead of a required ELD. The next trip should be planned under normal HOS and recordkeeping rules. A separate limited agricultural-operations exception in 49 CFR 395.1(k) may apply to certain farm supplies within 150 air miles and during a state-defined planting or harvesting period, but it has its own conditions and is not an automatic extension of the fertilizer waiver.
Transitioning from waiver operations to a normal trip
FMCSA expressly requires 10 consecutive hours off duty before normal operations when total time under the waiver, or a combination of waiver and normal operations, equals or exceeds 14 hours. Drivers operating without an ELD under the waiver had to maintain paper records of duty status and supporting documents and retain them for six months. Expiration does not erase those retention duties. The carrier should verify available hours, properly close the paper log and resume ELD use before the next operation for which an ELD is required.
Requirements the waiver never removed
The waiver did not remove CDL requirements, medical qualification, drug and alcohol testing, insurance, vehicle-condition rules, size and weight limits, registration, taxes or other FMCSRs. A driver subject to an out-of-service order could not use the relief until the order was rescinded in writing. A valid license and medical status, proper class and endorsements remained mandatory throughout the waiver and remain mandatory after it ends.
Practical implications for Ukrainian drivers
Citizenship, TPS, Uniting for Ukraine parole, a visa or an EAD does not determine eligibility for the fertilizer waiver; the cargo, route, state and compliance with its conditions were controlling. Ukrainian drivers transporting fertilizer on August 26–27 should obtain written dispatch instructions, identify when the qualifying segment ends, verify available HOS with the carrier or ELD system, and not treat an old copy of the waiver as valid after the deadline. Immigration documents and non-domiciled CDL validity must be monitored separately; this waiver does not extend them.
