Extension of Emergency Declaration No. 2026-006 прямо встановлювала кінцевий строк: завершення emergency або 11:59 p.m. ET 11 серпня 2026 року, залежно від того, що станеться раніше. Практичні наслідки для українських водіїв

Українським company drivers та owner-operators, які виконували Texas flood-relief loads, варто отримати від carrier письмове підтвердження часу завершення direct assistance, перевірити ELD log і переконатися, що перед наступним звичайним рейсом виконано required rest. TPS, U4U parole, EAD або citizenship не впливають на цей HOS deadline. Не покладайтеся на старий dispatch note чи збережену копію declaration як на дозвіл продовжувати relief після 11:59 p.m. ET 11 серпня.

The official HOS relief has ended

Extension of Emergency Declaration No. 2026-006 stated a clear endpoint: the end of the emergency or 11:59 p.m. ET on August 11, 2026, whichever occurred first. As of the morning of August 12, FMCSA has not posted a new extension on its Emergency Declarations page. The prior relief from 49 CFR 395.3 therefore may not be used for new driving time after the deadline solely on the basis of Declaration No. 2026-006.

What changes for subsequent trips

Property-carrying drivers continuing interstate operations on or after August 12 must again comply with the normal federal HOS limits, including the applicable driving window, on-duty window, required breaks and off-duty time. A carrier should not label an ordinary commercial delivery as emergency movement, and a driver should not continue using an exemption annotation in the ELD without another valid legal basis.

Transitioning from emergency work to normal operations

The declaration included a transition rule allowing a driver to return empty to the terminal or normal work-reporting location after direct assistance ended. If combined emergency-relief work and normal operations equaled or exceeded 14 hours and the driver continued transporting property, a 10-hour break was required before normal operations. After the declaration’s general expiration, the safety department should verify the final qualifying movement, ELD annotations and actual rest time before a new dispatch.

Other requirements remained in force throughout

Even while the declaration was active, relief applied only to 49 CFR 395.3 and only to direct assistance. It did not waive CDL requirements in Part 383, drug and alcohol testing in Part 382, insurance in Part 387, hazardous-materials rules, vehicle condition, size and weight limits, or out-of-service orders. Expiration does not change those rules; it removes only the temporary HOS relief.

Practical implications for Ukrainian drivers

Ukrainian company drivers and owner-operators who handled Texas flood-relief loads should obtain written confirmation from the carrier showing when direct assistance ended, review the ELD log, and confirm the required rest was completed before the next ordinary trip. TPS, U4U parole, an EAD or citizenship does not affect this HOS deadline. Do not rely on an old dispatch note or saved declaration as authority to continue the relief after 11:59 p.m. ET on August 11.
