Flexible Sleeper Berth: що тестуватимуть
Для selected participants pilot дозволятиме ділити щонайменше 10 годин required rest на два periods у різних combinations, якщо один period містить не менше п’яти consecutive hours у sleeper berth. Це дає змогу дослідити 6/4 і 5/5 splits. За чинним загальним rule property-carrying driver зазвичай може використовувати split від 7/3 до 8/2; 6/4 і 5/5 не стають доступними для всіх лише через це announcement.
Split Duty Period: pause до трьох годин
Другий pilot досліджуватиме, чи може driver безпечно pause 14-hour driving window до трьох годин на день під час qualifying non-driving time. До нього можуть входити off-duty або sleeper-berth time, а також on-duty/not-driving time на pickup чи delivery location. FMCSA зазначає, що моніторитиме shippers, щоб flexibility не спричинила додатковий detention або pressure на водіїв.
Pre-tests і масштаб 2027 року
Flexible Sleeper Berth pre-test тривав з 1 квітня до 11 червня та охопив дев’ять водіїв із трьох carriers у Ohio, Virginia і Wisconsin. Split Duty Period pre-test проходив з 18 травня до 17 липня з дев’ятьма водіями із трьох carriers у Minnesota, Wisconsin і Ohio. У 2027 році FMCSA очікує по 256 drivers у кожному pilot — 512 загалом. Planned participation триватиме чотири місяці, а driver може отримати до $1,600 за виконання study tasks.

Практичні наслідки для українських водіїв
Ukrainian citizenship, TPS, Uniting for Ukraine parole, visa або EAD самі по собі не надають і не скасовують доступ до pilot. Driver повинен мати valid CDL і legal authority to work та drive, а non-domiciled credential має залишатися чинним за current federal і state rules. Зацікавленим водіям варто залучити carrier safety manager, перевірити CDL, medical status та ELD records і не змінювати logs до отримання письмового participant approval та program instructions.
Чинні HOS rules продовжують діяти
До formal enrollment у pilot property-carrying drivers мають виконувати current 49 CFR Part 395, включно з 11-hour driving limit, 14-hour window, applicable breaks, 60/70-hour limits та чинними sleeper-berth provisions. Announcement не є waiver для general public і не дозволяє самостійно pause clock або використовувати 5/5 split. What FMCSA announced
On August 27, 2026, FMCSA announced that it had completed limited pre-tests for the Flexible Sleeper Berth and Split Duty Period pilot programs. The agency tested procedures, data collection and participation requirements ahead of a planned full launch in 2027. FMCSA is now reviewing the pre-test results and plans to refine both study designs.
What the Flexible Sleeper Berth pilot will test
For selected participants, the pilot will allow at least 10 hours of required rest to be divided into two periods in different combinations when one period includes at least five consecutive hours in the sleeper berth. This permits study of 6/4 and 5/5 splits. Under the current generally applicable rule, a property-carrying driver may normally use splits ranging from 7/3 to 8/2; the announcement does not make 6/4 or 5/5 available to everyone.
Split Duty Period: a pause of up to three hours
The second pilot will study whether a driver can safely pause the 14-hour driving window for up to three hours per day during qualifying non-driving time. That time may include off-duty or sleeper-berth time, as well as on-duty/not-driving time at a pickup or delivery location. FMCSA says it will monitor shippers so the flexibility does not produce additional detention or pressure on drivers.
The pre-tests and planned 2027 scale
The Flexible Sleeper Berth pre-test ran from April 1 through June 11 and included nine drivers from three carriers in Ohio, Virginia and Wisconsin. The Split Duty Period pre-test ran from May 18 through July 17 with nine drivers from three carriers in Minnesota, Wisconsin and Ohio. In 2027, FMCSA expects 256 drivers in each pilot, or 512 total. Planned participation will last four months, and a driver may receive up to $1,600 for completing study tasks.
How to express interest in participation
FMCSA asks professional drivers and motor carriers interested in the expanded 2027 pilots to send contact information to pilots@dot.gov. This is only a request for updates, not automatic enrollment or permission to use experimental HOS options. Formal selection is expected to depend on final participation procedures; the earlier Federal Register notices contemplated a valid CDL, current medical qualification, carrier approval or owner-operator status, and safety-related eligibility checks.
Practical implications for Ukrainian drivers
Ukrainian citizenship, Temporary Protected Status, Uniting for Ukraine parole, a visa or an EAD does not by itself grant or cancel access to a pilot. A driver must have a valid CDL and legal authority to work and drive, and any non-domiciled credential must remain valid under current federal and state rules. Interested drivers should involve the carrier’s safety manager, verify the CDL, medical status and ELD records, and not change logging practices without written participant approval and program instructions.
Current HOS rules remain in effect
Unless formally enrolled in a pilot, property-carrying drivers must comply with current 49 CFR Part 395, including the 11-hour driving limit, 14-hour window, applicable breaks, 60/70-hour limits and current sleeper-berth provisions. The announcement is not a waiver for the general public and does not allow a driver to pause the clock or use a 5/5 split independently.
