PAM Transport Seeks CLP Exemption After Skills Test; Current Rule Remains in Effect

За чинним 49 CFR 383.25(a)(1), CLP holder має бути accompanied and directly supervised by CDL holder із належним vehicle group та потрібними endorsements.

PAM Transport

PAM просить дозволити qualifying CLP holder, який уже успішно склав CDL skills test, керувати CMV під час trip назад до State of domicile для отримання CDL credentials.

За application, PAM перевіряла б valid CLP і state driver license, proof of successful skills test, required endorsements, medical qualification, відсутність out-of-service order або suspension, виконання company driver-qualification requirements і присутність належно licensed CDL holder у CMV. Driver мав би мати при собі CLP, driver license, proof of passed skills test та копію exemption.

Воно не замінює ELDT, не видає CDL, не дозволяє керувати до passing skills test і не скасовує HOS, ELD, drug and alcohol testing, medical certification, vehicle-safety, English-proficiency або state licensing requirements. Воно також не змінює immigration status, work authorization чи federal eligibility для non-domiciled CDL.

IN ENGLISH

What FMCSA published on October 27

FMCSA published notice of PAM Transport Inc.’s application and opened a public comment period through November 27, 2026. The company seeks a five-year exemption from one element of 49 CFR 383.25(a)(1): where the supervising CDL holder must be seated while a CLP holder operates the CMV. The notice begins the review; it is not a decision. The agency expressly says it will separately grant or deny the request after reviewing the application, safety materials and public comments.

The current rule remains unchanged

Under current 49 CFR 383.25(a)(1), a CLP holder must be accompanied and directly supervised by a CDL holder with the proper vehicle group and required endorsements. In a truck, the supervising CDL holder must be physically present in the front seat beside the CLP holder. PAM’s application alone therefore does not authorize a dispatcher, trainer or driver to change that seating arrangement. The ordinary rule remains in force unless a particular operation is covered by another effective exemption.

What PAM Transport is requesting

PAM asks to allow a qualifying CLP holder who has already passed the CDL skills test to operate a CMV during a trip back to the driver’s state of domicile to obtain CDL credentials. A qualified CDL holder with the proper class and endorsements would remain in the CMV but would not necessarily occupy the front passenger seat. PAM estimates that approximately 500 to 700 CLP holders per year could operate under the exemption and argues that it would reduce post-test idle time and permit a revenue-generating trip. Those are the applicant’s claims, which FMCSA has not yet accepted.

Proposed conditions and documents

Under the application, PAM would verify a valid CLP and state driver’s license, proof of a successful skills test, required endorsements, medical qualification, the absence of an out-of-service order or suspended privileges, compliance with company driver-qualification requirements and the presence of a properly licensed CDL holder in the CMV. The driver would carry the CLP, driver’s license, proof of passing the skills test and a copy of the exemption. PAM also proposes to document operations and monitor safety performance. These conditions are not current authorization; they describe the requested program.

What the proposed exemption would not waive

Even if FMCSA later grants the request, the relief would be company-specific and would address only the front-seat supervision requirement for eligible PAM drivers. It would not replace ELDT, issue a CDL, permit operation before passing the skills test, or waive hours-of-service, ELD, drug-and-alcohol testing, medical-certification, vehicle-safety, English-proficiency or state licensing requirements. It also would not change immigration status, work authorization or federal eligibility for a non-domiciled CDL.

Practical implications for Ukrainian drivers

A Ukrainian applicant who trains in one state while holding a CLP from another should not treat the notice as permission to drive after the skills test. Until a final grant is published, require front-seat supervision under the current rule. If the exemption is later granted and PAM offers participation, obtain written confirmation from the safety department; verify personal eligibility, the supervising driver’s class and endorsements, the exact skills-test date, the permitted route and every required in-cab document. Uniting for Ukraine parole, Temporary Protected Status, a visa or an Employment Authorization Document must be evaluated separately from CDL and employment requirements.

How to comment by November 27

Comments may be filed in docket FMCSA-2026-3466 through Regulations.gov through November 27, 2026. FMCSA asks commenters to identify the portion of the notice they support or oppose and provide reasons or supporting material. Submissions become searchable public records, so do not include a CDL number, Social Security number, immigration document, medical information or other unnecessary personal data. The agency may consider late comments only to the extent practicable.
