NPRM запускає rulemaking і public-comment process; він не створює нового тесту чи окремого deadline для водіїв 8 серпня. Що саме пропонує FMCSA

FMCSA пропонує змінити 49 CFR 390.5, 390.5T і 391.11(b)(2), щоб прямо встановити: driver, який не відповідає чинній English-language-proficiency qualification, має бути placed out of service. Agency пояснює, що мета — узгодити federal regulations із поточними CVSA North American Standard Out-of-Service Criteria та створити однаковий nationwide standard. Roadside перевірки ELP уже діють

Що означає English-language proficiency

49 CFR 391.11(b)(2) вимагає від CMV driver достатньо читати й говорити англійською, щоб спілкуватися з public, розуміти highway traffic signs і signals, відповідати на official inquiries та робити записи у reports і records. Це driver-qualification standard, а не тест citizenship, nationality, accent або мови вдома. Border zones та public comments

NPRM описує вузьке виключення для current trip, який не передбачає transportation у США поза U.S.–Mexico border commercial zones; це не загальне border exemption. Comments прийматимуть 60 днів після офіційної публікації. Якщо документ опублікують 10 серпня, очікуваний deadline — 9 жовтня 2026 року, але контрольну дату визначає фінальна Federal Register notice. Практичні наслідки для українських водіїв

Стандарт застосовується незалежно від citizenship, TPS, U4U parole, visa або типу CDL. Перед рейсом потренуйте коротко пояснювати англійською route, cargo, origin, destination, hours, shipping papers і vehicle defects та повторіть common highway signs. Тримайте CDL, medical status, HOS і shipping documents доступними. Якщо inspector видав citation або OOS order, не сперечайтеся roadside: попросіть копію report, зафіксуйте точну regulation і зверніться до carrier safety team та кваліфікованого attorney. OOS order не є автоматично immigration detention, criminal conviction або CDL revocation.

This is a proposal, not a final rule

On August 7, 2026, FMCSA announced a notice of proposed rulemaking (NPRM) in docket FMCSA-2026-0826. The public-inspection document is scheduled for Federal Register publication on August 10. An NPRM begins the rulemaking and public-comment process; it does not create a new test or a separate driver deadline on August 8. The text may change before a final rule, and the current date and status should be verified in the Federal Register and Regulations.gov.

What FMCSA is proposing

FMCSA proposes to amend 49 CFR 390.5, 390.5T and 391.11(b)(2) to state expressly that a driver who does not meet the existing English-language-proficiency qualification must be placed out of service. The agency says the purpose is to align federal regulations with the current CVSA North American Standard Out-of-Service Criteria and create a uniform nationwide standard. The NPRM is new because it would place the consequence in the regulation, not because it creates the English requirement for the first time.

Roadside ELP checks are already in effect

Current FMCSA enforcement policy already provides for roadside assessment of English proficiency. The inspector begins in English; when a concern arises, the inspector conducts a driver interview and, if the interview is passed, a sign-recognition assessment. A driver may already be placed out of service under the current enforcement criteria. Waiting for a final rule is therefore not a reason to ignore ELP preparation or current inspector instructions.

What English-language proficiency means

49 CFR 391.11(b)(2) requires a CMV driver to read and speak English well enough to communicate with the public, understand highway traffic signs and signals, respond to official inquiries, and make entries on reports and records. It is a driver-qualification standard, not a test of citizenship, nationality, accent or the language used at home. For a driver with a federal hearing-standard exemption, FMCSA guidance separately permits ELP to be assessed through reading and writing English instead of speaking.

Border zones and public comments

The NPRM describes a narrow exception for a current trip that does not involve transportation in the United States outside the U.S.–Mexico border commercial zones; it is not a general border exemption. Comments will be accepted for 60 days after official publication. If the document is published on August 10, the expected deadline is October 9, 2026, but the final Federal Register notice controls. Comments may be filed through Regulations.gov in docket FMCSA-2026-0826.

Practical implications for Ukrainian drivers

The standard applies regardless of citizenship, TPS, U4U parole, visa or CDL type. Before a trip, practice briefly explaining the route, cargo, origin, destination, hours, shipping papers and vehicle defects in English, and review common highway signs. Keep the CDL, medical status, HOS and shipping documents accessible. If an inspector issues a citation or out-of-service order, do not argue roadside: request a copy of the report, record the exact regulation, and contact the carrier safety team and a qualified attorney. An out-of-service order is not automatically an immigration detention, criminal conviction or CDL revocation.
