FMCSA final rule змінило в 49 CFR 390.23(b) automatic relief period для regional declarations of emergency з 14 до 30 days. Rule опубліковано та введено в дію 5 жовтня 2026 року. Для qualifying declaration relief триває до завершення emergency period або до 30-го дня від initial declaration — залежно від того, що настане раніше. FMCSA пояснює, що зміна має зменшити кількість extension requests, які виникали через попередній 14-day limit.

Які declarations запускають 30-day period

Зміна стосується regional emergency declaration, виданої Governor, authorized representative Governor або FMCSA. Вона не перетворює будь-який weather alert, company emergency чи dispatcher message на federal exemption. Окремі правила залишаються для presidential declarations, local emergencies, tow trucks за police request і residential heating fuel shortages. Перед рейсом потрібен actual official declaration і перевірка його geographic scope, effective time, covered assistance та можливого early termination.

Relief обмежене HOS і direct assistance

Для звичайної regional declaration automatic exemption стосується 49 CFR 395.3 для property-carrying drivers і 395.5 для passenger-carrying drivers лише тоді, коли motor carrier або driver надає direct assistance у відповідь на declared emergency. Cargo або service мають бути безпосередньо пов’язані з emergency relief effort. Звичайний commercial load, backhaul чи наступний dispatch не стає exempt лише тому, що маршрут проходить через declared area.

Що rule не скасовує

FMCSA emergency guidance прямо зазначає, що federal emergency relief не звільняє від CDL requirements, drug and alcohol rules, hazardous-materials rules, size and weight limits, registration або tax requirements. Governor declaration може окремо змінювати деякі state requirements, але це потрібно читати в самому order. Навіть під час relief carrier і driver не повинні керувати у fatigued, ill або clearly unsafe condition.

Коли exemption припиняється для конкретного driver

Relief припиняється, коли driver завершує direct assistance, перевозить у interstate commerce cargo, який не призначений для emergency effort, або отримує dispatch до іншого місця для звичайної роботи. Rule дозволяє empty return до terminal або normal reporting location без previously exempted requirements. Якщо driver повідомляє, що потребує immediate rest, carrier має надати щонайменше 10 consecutive hours off duty до вимоги повернутися.

Практичні кроки для українських drivers і owner-operators

Перед використанням relief відкрийте official declaration, запишіть issuing authority, declaration number, initial date, geographic area і covered cargo або service. Збережіть bill of lading, dispatch record, delivery location та інший proof direct assistance; правильно відображайте duty status і notes у ELD відповідно до carrier procedure. Ukrainian citizenship, U4U parole, TPS, EAD або інший immigration document не розширює і не звужує цей HOS relief, але current CDL, endorsements, medical qualification і work authorization залишаються окремими обов’язковими питаннями.

Перевіряйте кожну declaration окремо

30 days — це maximum automatic period, а не гарантований строк для кожного рейсу. Declaration може закінчитися раніше, бути змінена або мати вужчі умови; FMCSA також може formally extend relief за 49 CFR 390.25. Для declarations, виданих до October 5 effective date, не припускайте автоматично нову expiration date — перевірте current state order, FMCSA listing та будь-яку extension або termination notice.

What changed on October 5

FMCSA’s final rule changes the automatic relief period in 49 CFR 390.23(b) for regional emergency declarations from 14 to 30 days. The rule was published and became effective on October 5, 2026. For a qualifying declaration, relief lasts until the emergency period ends or until 30 days after the initial declaration—whichever occurs first. FMCSA says the change should reduce extension requests created by the previous 14-day limit.

Which declarations trigger the 30-day period

The change applies to a regional emergency declaration issued by a Governor, the Governor’s authorized representative or FMCSA. It does not turn every weather alert, company emergency or dispatcher message into a federal exemption. Separate rules continue to govern presidential declarations, local emergencies, tow trucks responding to police requests and residential heating fuel shortages. Before a trip, there must be an actual official declaration and a check of its geographic scope, effective time, covered assistance and any early termination.

Relief is limited to HOS and direct assistance

For an ordinary regional declaration, the automatic exemption covers 49 CFR 395.3 for property-carrying drivers and 395.5 for passenger-carrying drivers only while the motor carrier or driver is providing direct assistance in response to the declared emergency. The cargo or service must be directly connected to the emergency relief effort. An ordinary commercial load, backhaul or later dispatch does not become exempt merely because the route passes through a declared area.

What the rule does not waive

FMCSA emergency guidance states that federal emergency relief does not waive CDL requirements, drug and alcohol rules, hazardous-materials requirements, size and weight limits, registration or tax obligations. A Governor’s declaration may separately modify certain state requirements, but those changes must be found in the order itself. Even during relief, a carrier and driver should not operate while fatigued, ill or under clearly unsafe conditions.

When the exemption ends for a particular driver

Relief ends when a driver finishes direct assistance, transports interstate cargo that is not destined for the emergency effort, or is dispatched elsewhere to begin ordinary commercial operations. The rule permits an empty return to the terminal or normal reporting location without the previously exempted requirements. If the driver reports needing immediate rest, the carrier must provide at least 10 consecutive hours off duty before requiring that return.

Practical steps for Ukrainian drivers and owner-operators

Before relying on relief, open the official declaration and record the issuing authority, declaration number, initial date, geographic area and covered cargo or service. Retain the bill of lading, dispatch record, delivery location and other proof of direct assistance, and accurately record duty status and notes in the ELD under the carrier’s procedure. Ukrainian citizenship, Uniting for Ukraine parole, TPS, an EAD or another immigration document neither expands nor narrows this HOS relief, while a current CDL, endorsements, medical qualification and work authorization remain separate requirements.

Check every declaration separately

Thirty days is the maximum automatic period, not a guaranteed duration for every trip. A declaration may end sooner, be modified or contain narrower conditions, and FMCSA may formally extend relief under 49 CFR 390.25. For declarations issued before the October 5 effective date, do not assume a new expiration date automatically; check the current state order, FMCSA listing and any extension or termination notice.
