DOT Inspector General

16 жовтня 2026 року U.S. DOT Office of Inspector General повідомив, що federal grand jury у Eastern District of Louisiana indicted Chris Sequeira, колишнього third-party CDL tester. За версією indictment, у липні 2024 року він зробив три separate false entries щодо CDL skills tests у Commercial Skills Test Information Management System — CSTIMS — із intent to impede proper administration of DOT.

AAMVA описує CSTIMS як internet-based system, через яку jurisdictions і third-party examiners schedule tests та enter commercial skills-test results. За 49 CFR 383.75(b), third-party tester має secure electronic means повідомити State Driver Licensing Agency, коли applicant проходить skills test.

Louisiana CDLs

Indictment містить allegations, а не findings of guilt.

49 CFR 383.75 дозволяє state authorizing third-party skills testing лише за визначених умов. State має certify testers і examiners, conduct onsite inspection щонайменше раз на два роки, використовувати covert test, co-scoring або sample retesting, зберігати право на prompt remedial action та дозволяти random audits FMCSA. Tester також має зберігати scoring sheets за current і два попередні calendar years, approved routes, examiner certificates та training records.

Використовуйте tester, який currently authorized state OMV/DMV, і звіряйте legal business name та examiner. Збережіть appointment confirmation, payment receipt, vehicle information, score sheet або proof of testing, дату й location. Після видачі CDL перевіряйте credential status через official state channel.

Criminal investigation не змінює автоматично immigration status або work authorization, але індивідуальна licensing action чи allegation може потребувати окремої legal та immigration advice.

Court filings, state notices IN ENGLISH

What the DOT Inspector General reported

On October 16, 2026, the U.S. Department of Transportation Office of Inspector General reported that a federal grand jury in the Eastern District of Louisiana indicted Chris Sequeira, a former third-party CDL tester. The indictment alleges that in July 2024 he made three separate false entries involving CDL skills tests in the Commercial Skills Test Information Management System, or CSTIMS, with intent to impede the proper administration of DOT. DOT-OIG is investigating with the FBI. Overdrive reported the case on October 29; the public OIG notice does not identify the three applicants, test dates, CDL classes or current status of their credentials.

What CSTIMS is and why an entry matters

AAMVA describes CSTIMS as an internet-based system through which jurisdictions and third-party examiners schedule tests and enter commercial skills-test results. The system applies state-defined business rules, generates alerts about violations and produces reports to identify potential fraud patterns. Under 49 CFR 383.75(b), a third-party tester must notify the State Driver Licensing Agency through secure electronic means when an applicant passes the skills test. A database entry is therefore an important part of the licensing process, but it does not replace actually completing the required pre-trip, basic-control and on-road portions.

The indictment does not cancel every Louisiana CDL

An indictment contains allegations, not findings of guilt. Sequeira is presumed innocent unless and until the government proves guilt beyond a reasonable doubt. The public notice describes three alleged entries and does not say that every test administered by this examiner, every Louisiana third-party test or every CDL is invalid. It also announces no blanket recall, suspension or retest order for other applicants. If the state or a court identifies specific affected records, consequences should be communicated through official notice and the applicable licensing process—not through rumor or a social-media list.

Federal safeguards for third-party testers

49 CFR 383.75 allows a state to authorize third-party skills testing only under specified conditions. The state must certify testers and examiners, conduct an onsite inspection at least once every two years, use covert testing, co-scoring or sample retesting, retain authority for prompt remedial action and permit random FMCSA audits. A tester must also retain scoring sheets for the current and two prior calendar years, approved routes, examiner certificates and training records. A bond must be sufficient to pay for retesting drivers if an examiner is involved in fraudulent testing. These safeguards do not prove the allegation in a particular criminal case, but they explain how records can be reviewed.

What an applicant should do after a legitimate skills test

Use a tester currently authorized by the state OMV or DMV and verify the legal business name and examiner. Personally complete every required test portion; do not pay a broker for a “guaranteed pass,” proxy driver, altered score sheet or database entry without a test. Keep the appointment confirmation, payment receipt, vehicle information, score sheet or proof of testing, date and location. After the CDL is issued, check credential status through the official state channel. If you receive a retest, suspension or investigation notice, do not ignore it: preserve the envelope and originals, follow any appeal deadline and consult an attorney experienced in CDL licensing.

Practical implications for Ukrainian and immigrant drivers

Nationality, accent, Uniting for Ukraine parole, Temporary Protected Status, a visa or an Employment Authorization Document does not prove participation in test fraud. Every applicant must nevertheless personally complete the required English-language knowledge and skills processes and refuse a false record. A Ukrainian driver who legitimately tested in Louisiana does not need to surrender a CDL merely because of this headline without an official notice. Keep the CLP, ELDT record, receipts, score documents, CDL and communications. A criminal investigation does not automatically change immigration status or work authorization, but an individualized licensing action or allegation may require separate legal and immigration advice.
