CLP exam

Massachusetts Man Charged in Alleged Bluetooth CLP Exam Scheme

U.S. Attorney’s Office for the District of Massachusetts повідомив, що 42-річного Rudy Nolasco з Lynn обвинувачено в одному count fraudulent production of an identification document.

Frank Castro

DOJ зазначає, що Castro був засуджений у січні 2026 року та в травні отримав sentence of time served — приблизно 23 months.

Після CLP applicant зазвичай має виконати ELDT requirements, пройти skills test та інші federal і state checks перед видачею CDL.

CDL schools

Водночас arrest, charge чи investigation не є автоматичним доказом CDL fraud, immigration violation або відсутності work authorization. Українським applicants варто окремо перевіряти CLP/CDL eligibility у state DMV та current employment authorization; school, recruiter або paid “helper” не може гарантувати approval.

IN ENGLISH

What federal prosecutors announced

On October 15, 2026, the U.S. Attorney’s Office for the District of Massachusetts announced that 42-year-old Rudy Nolasco of Lynn had been charged with one count of fraudulent production of an identification document. DOJ says he appeared before a magistrate judge on October 13 and was released on conditions set by the court. The charging document contains an allegation; the case has not been resolved.

How the scheme allegedly worked

Prosecutors allege that in November 2021 Nolasco brought a concealed Bluetooth earpiece into a Massachusetts CLP knowledge exam while Frank Castro supplied answers. DOJ also alleges that Nolasco later explained to an undercover agent how the scheme worked and how payment was made. FreightWaves, citing an affidavit and RMV records, reports phone contacts, payment records and a controlled exam; those details remain government claims that must be proved in court.

The separate Frank Castro case

DOJ says Castro was convicted in January 2026 and sentenced in May to time served—approximately 23 months. His conviction does not establish Nolasco’s guilt. Each defendant and each alleged transaction is evaluated separately, and Nolasco is presumed innocent unless and until guilt is proved beyond a reasonable doubt.

A CLP exam is not the same as a full CDL

Commercial Learner’s Permit knowledge tests are an early stage of the CDL process. After receiving a CLP, an applicant generally must satisfy applicable ELDT requirements, pass a skills test and complete other federal and state checks before a CDL is issued. The published DOJ announcement and news report do not establish that Nolasco obtained a full CDL, operated a commercial motor vehicle or caused a safety incident. They also do not prove fraud by other Massachusetts CLP or CDL holders.

Practical steps for applicants and CDL schools

Prepare with the official CDL manual, a legitimate ELDT provider and permitted study materials. Do not pay for a “guaranteed pass,” remote answers, concealed equipment or a completion record for training that did not occur. Keep enrollment agreements, receipts, attendance and test records. If someone offers a cheating service or asks for a login, identity document or biometric data, stop the contact and verify a reporting channel through the DMV or law-enforcement agency—not through a link supplied by the intermediary.

What this means for Ukrainian and immigrant drivers

Exam-integrity enforcement applies regardless of citizenship or immigration category. At the same time, an arrest, charge or investigation is not automatic proof of CDL fraud, an immigration violation or a lack of work authorization. Ukrainian applicants should separately verify CLP/CDL eligibility with the state DMV and confirm current employment authorization; a school, recruiter or paid “helper” cannot guarantee approval. Do not give a passport, I-94, EAD or Social Security data to an unverified intermediary.

Potential penalty and informational disclaimer

DOJ lists a statutory maximum of up to 15 years in prison, up to three years of supervised release and a fine of up to $250,000. That is the maximum allowed by statute, not a predicted sentence; any penalty would be determined by a judge under the guidelines and facts. This article summarizes the official announcement and reporting available as of October 20, 2026. It is not legal, criminal-defense, CDL or immigration advice.
