Oral argument is scheduled for September 28
In State of New York v. U.S. Department of Transportation, No. 26-1097, the U.S. Court of Appeals for the Second Circuit will hear oral argument on September 28, 2026, in Manhattan. New York and the New York DMV challenge FMCSA’s April 16 final determination finding the state CDL program substantially noncompliant and linking that determination to the withholding of approximately $73.5 million in federal highway funding. The hearing date itself is not a court decision.
What the federal audit found
FMCSA reported that 107 of 200 sampled non-domiciled CDL records, or 53%, contained violations. The dispute materials describe 101 credentials with expiration dates extending beyond the lawful-presence document presented at issuance. The agency also identified records it says lacked sufficient proof of current lawful presence and directed the state to pause new, renewed, transferred or upgraded non-domiciled credentials, conduct a comprehensive audit and revoke credentials it considers noncompliant. These are FMCSA’s findings, which New York disputes.
New York’s argument
New York argues that the regulations governing the disputed transactions did not expressly require a CDL expiration date to match the expiration of an EAD or another lawful-presence document. The state also points to earlier federal reviews and contends that FMCSA applied a new interpretation to older transactions. New York asks the court to set aside the federal noncompliance determination and funding penalty. Filing the challenge does not by itself establish that the state’s interpretation is correct.
DOT and FMCSA’s argument
According to their filed brief, the federal respondents argue that issuance eligibility was already tied to lawful presence and that credentials extending years beyond the period demonstrated at application were improperly issued. DOT also emphasizes that New York was required to work with FMCSA on corrective action after the audit findings. The court will determine whether the final determination complies with the governing statutes and regulations and whether the agency action was lawful and adequately reasoned.
What this means for an existing CDL
The September 28 hearing does not cancel every New York non-domiciled CDL, guarantee renewal or erase an individual DMV notice. A decision may come later and could uphold, vacate or remand the federal determination. Until an official ruling, drivers should rely on the current New York DMV record, written notices and the current FMCSA 2026 final rule. Do not rely on a carrier, dispatcher or social-media post claiming that a license has been automatically extended or cancelled.
Practical implications for Ukrainian drivers
A Ukrainian driver holding a New York CDL should obtain a current driving record, compare the CDL expiration with passport, Form I-94, visa, parole or EAD dates, and retain every DMV letter. Uniting for Ukraine parole, Temporary Protected Status or employment authorization may be important immigration documents, but they do not automatically determine non-domiciled CDL eligibility. If the DMV requests surrender, downgrade, reapplication or additional proof, ask for written instructions and consult a qualified attorney before missing a deadline.
