Що Ohio BMV оголосила

23 жовтня Ohio Bureau of Motor Vehicles повідомила, що state повністю завершує non-domiciled CDL program. Transport Topics опублікував додатковий state-by-state context 30 жовтня.

Notice, 30 днів і право request a hearing

State також визнає право request a BMV hearing.

FMCSA final rule, effective March 16, limits new non-domiciled CDL eligibility primarily to verified H-2A, H-2B та E-2 status and requires in-person verification for issuance, renewal, transfer, upgrade and certain duplicate transactions. Federal rules describe коли state may issue a non-domiciled credential; вони не require every state to maintain such a program. Ohio обрала stricter operational policy — discontinue program for remaining holders. Ohio non-domiciled CDL.

Ohio

Збережіть CDL/CLP applications, I-94, passport, visa, EAD, SAVE-related correspondence, prior BMV letters, medical certification та employer records.

IN ENGLISH

What Ohio BMV announced

On October 23, the Ohio Bureau of Motor Vehicles announced that the state is fully ending its non-domiciled CDL program. The decision follows a review of approximately 5,000 Ohio credentials under updated FMCSA requirements. BMV says about 2,000 credentials have already been downgraded because the holders were ineligible; the agency now plans to downgrade all remaining non-domiciled CDLs to standard driver licenses. Transport Topics published additional state-by-state context on October 30. Ohio has not issued or renewed these credentials since September 2025.

What a downgrade means

In this context, a downgrade removes the commercial driving privilege from the Ohio license. A standard Class D license does not authorize operation of a vehicle that requires a CDL. This is not a criminal conviction, an immigration removal order or an automatic cancellation of work authorization. Once the downgrade is effective, however, the driver must not operate on a CDL-required route even if the physical card has not yet been replaced, the employer has not received a separate notice or the driver intends to challenge the action.

Notice, 30 days and the right to request a hearing

BMV says affected holders will receive a letter and the downgrade will take effect 30 days after the date of that notice. The state also recognizes the right to request a BMV hearing. A driver should follow the instructions and deadline in the individual letter: preserve the envelope, copy the notice, verify the mailing date, submit the hearing request by the stated method and retain delivery proof. The public announcement does not promise that requesting a hearing automatically extends CDL privileges, so a driver should not assume a stay without written confirmation from BMV or legal advice.

Ohio policy and federal eligibility are not the same question

The FMCSA final rule, effective March 16, generally limits new non-domiciled CDL eligibility to verified H-2A, H-2B and E-2 status and requires in-person verification for issuance, renewal, transfer, upgrade and certain duplicate transactions. Federal rules describe when a state may issue a non-domiciled credential; they do not require every state to maintain such a program. Ohio has chosen a stricter operational policy by discontinuing the program for remaining holders. A driver’s potential eligibility under a federal visa category therefore does not by itself guarantee an Ohio renewal or preservation of an Ohio non-domiciled CDL.

Practical steps for Ukrainian drivers in Ohio

Verify the address in the BMV record and monitor mail daily. Do not ignore a letter even if the expiration date printed on the CDL is later. Preserve CDL and CLP applications, Form I-94, passport, visa, EAD, SAVE-related correspondence, prior BMV letters, medical certification and employer records. Uniting for Ukraine parole, TPS or an EAD may establish separate immigration or work-authorization facts, but they do not create automatic eligibility under the current non-domiciled CDL rule. Do not surrender original documents without a receipt. If the credential is essential for employment, promptly consult an Ohio CDL attorney; address immigration questions separately with qualified immigration counsel.

What carriers and employers should do

A carrier should not rely only on the expiration date printed on the plastic CDL. Ask affected Ohio drivers to report BMV letters immediately and verify current license status through a lawful employer process. Do not assign CDL-required driving after an effective downgrade. At the same time, do not infer immigration status, fraud or misconduct merely from a non-domiciled label or BMV action. Employment, document reverification and anti-discrimination duties are separate issues that require a consistent policy and professional advice.
