17 вересня 2026 року U.S. District Judge Anthony J. Trenga задовольнив motion plaintiff states після hearing 10 вересня. Preliminary injunction замінює короткострокове temporary restraining order і діє до подальшого order суду. Це довший процесуальний захист status quo, але не final judgment: основний lawsuit залишається pending, а суд ще не виніс остаточного рішення щодо всіх claims.
Що саме забороняє новий order
Order забороняє AAMVA передавати DOT, FMCSA або будь-якій іншій agency CDLIS Master Pointer Records plaintiff states, охоплені оскаржуваною Data Demand. Він також забороняє DOT, FMCSA, Secretary of Transportation та FMCSA Administrator карати plaintiff states або AAMVA за відмову передати ці records — зокрема припиняти чи погрожувати припиненням federal contracts або funding чи робити інші дії, що можуть порушити роботу CDLIS або здатність states видавати CDL.
Scope не слід перебільшувати
Federal demand стосується приблизно 17 million Master Pointer Records за п’ятирічний період, але operative language injunction прямо захищає records plaintiff states у межах цієї demand. Суд також зазначив, що federal agencies зберігають доступ до CDLIS через specific individualized requests, як і раніше. Тому order не є blanket ban на кожен законний CDLIS query, background check, state-to-state licensing exchange або звичайну roadside verification.
Чому суд надав preliminary relief
Для цього етапу суд дійшов висновку, що plaintiffs показали likelihood of success on the merits, irreparable harm without relief, favorable balance of equities та public interest. Order обговорює ймовірні порушення Administrative Procedure Act, Driver’s Privacy Protection Act, Privacy Act, обов’язку federal consultation зі states та Spending Clause, а для кількох states — contract restrictions із AAMVA. Це preliminary findings для injunction, а не остаточне встановлення незаконності чи liability.
Що не змінилося для drivers і carriers
Injunction не анулює CDL або CLP, не створює нового roadside document і не змінює medical certification, HOS, Clearinghouse, ELDT, English-language proficiency, HazMat або vehicle-safety requirements. Воно також не забороняє FMCSA, DHS, state DMV чи law enforcement проводити інші lawful audits, investigations або individualized checks. Driver і carrier мають і далі виконувати чинні federal та state procedures.
Практичні наслідки для українських та immigrant drivers
Order не змінює eligibility для issuance, renewal, transfer, upgrade або reinstatement non-domiciled CDL і не змінює значення TPS, U4U parole, EAD, visa, I-94 чи work authorization. Українському driver не потрібно подавати новий пакет документів через injunction. Водночас case стосується bulk access до sensitive CDLIS data та заявленого immigration-enforcement purpose, тому зберігайте copies документів, перевіряйте будь-який запит на SSN, CDL image чи immigration papers через official channel і не припускайте, що загальне immigration або CDL enforcement припинилося.

The TRO has been replaced by a preliminary injunction
On September 17, 2026, U.S. District Judge Anthony J. Trenga granted the plaintiff states’ motion after a September 10 hearing. The preliminary injunction replaces the short-term temporary restraining order and remains in effect until further order of the court. It provides longer procedural protection for the status quo, but it is not a final judgment: the underlying lawsuit remains pending, and the court has not finally resolved all claims.
What the new order prohibits
The order bars AAMVA from transferring to DOT, FMCSA or any other agency the plaintiff states’ CDLIS Master Pointer Records covered by the challenged Data Demand. It also bars DOT, FMCSA, the Secretary of Transportation and the FMCSA Administrator from penalizing the plaintiff states or AAMVA for not transferring those records, including terminating or threatening federal contracts or funding or taking other action that could impair CDLIS operations or the states’ ability to issue CDLs.
The scope should not be overstated
The federal demand concerns approximately 17 million Master Pointer Records over a five-year period, but the injunction’s operative language expressly protects the plaintiff states’ records covered by that demand. The court also noted that federal agencies retain access to CDLIS through specific individualized requests, as before. The order therefore is not a blanket ban on every lawful CDLIS query, background check, state-to-state licensing exchange or ordinary roadside verification.
Why the court granted preliminary relief
At this stage, the court concluded that the plaintiffs showed a likelihood of success on the merits, irreparable harm without relief, a favorable balance of equities and a public interest in relief. The order discusses likely violations involving the Administrative Procedure Act, Driver’s Privacy Protection Act, Privacy Act, the federal duty to consult states and the Spending Clause, as well as AAMVA contract restrictions for several states. These are preliminary findings supporting an injunction, not a final determination of unlawfulness or liability.
What has not changed for drivers and carriers
The injunction does not cancel a CDL or CLP, create a new roadside document or change medical-certification, hours-of-service, Clearinghouse, ELDT, English-language-proficiency, hazardous-materials or vehicle-safety requirements. It also does not prevent FMCSA, DHS, state DMVs or law enforcement from conducting other lawful audits, investigations or individualized checks. Drivers and carriers must continue following current federal and state procedures.
Practical implications for Ukrainian and immigrant drivers
The order does not change eligibility for issuance, renewal, transfer, upgrade or reinstatement of a non-domiciled CDL, and it does not change the effect of Temporary Protected Status, Uniting for Ukraine parole, an Employment Authorization Document, a visa, Form I-94 or work authorization. Ukrainian drivers do not need to submit a new document package because of the injunction. Because the case concerns bulk access to sensitive CDLIS data and a stated immigration-enforcement purpose, keep copies of documents, verify any request for an SSN, CDL image or immigration papers through an official channel, and do not assume that general immigration or CDL enforcement has stopped.
