Що змінив Texas 28 вересня

What Texas changed on September 28
Governor Greg Abbott declared a diesel-fuel-shortage disaster in all 254 Texas counties. The proclamation suspends specified state notice, sales, highway-use and penalty provisions to allow expanded use of dyed diesel on public roads. This is temporary state emergency relief, not a nationwide change to federal trucking rules or CDL eligibility.
Dyed diesel is allowed, but the tax did not automatically disappear
Dyed diesel is marked with red dye and under ordinary rules is used mainly off road, including in agriculture. Texas suspended state restrictions and associated penalties, but the official announcement expressly says the underlying fuel tax was not waived. A carrier or owner-operator should retain invoices, gallons, purchase location, vehicle and trip records and obtain tax guidance from the Texas Comptroller; emergency permission should not be treated as an automatic federal or state tax exemption for every highway purchase.
The 95,000-pound limit applies only to specified loads
The order suspends certain Texas oversize and overweight permitting requirements only for vehicles loaded with fuel, agricultural or timber products and sets a 95,000-pound gross-weight ceiling. Separately, the Governor asked EPA to temporarily waive the federal ultra-low-sulfur diesel requirements in 40 CFR 1090.305 and allow substitution for Texas Low Emission Diesel in 110 counties. The state proclamation suspends the TxLED rule only to the extent authorized by EPA. As of September 29, no official EPA approval had been published, so drivers, fuel suppliers and carriers should not treat federal sulfur or TxLED requirements as waived merely because Texas submitted the request.
How long the relief lasts and what to check before a trip
The proclamation does not state a separate expiration date. Under Texas Government Code §418.014, a state of disaster may not continue for more than 30 days without renewal by the Governor and may end earlier. Before each trip, verify the current proclamation, any Governor or TxDOT conditions, route and bridge limits, and EPA status.
